A Metropolitan Police Special Constable has been convicted of racially aggravated public order offence which took place on a train between Gatwick and East Croydon.
A British Transport Police (BTP) spokesman said:
“I can confirm that Luke Smith (27) of Wandsworth, London, has been convicted of a racially aggravated public order offence.
“This is in relation to an incident which took place in the early hours of Wednesday, 5 October 2011 where Smith racially abused a 48-year-old member of rail staff on board a train between Gatwick and East Croydon.
“BTP officers were called to the scene at around 3.15am and Smith was arrested. BTP launched an investigation, spoke to a number of witnesses and viewed CCTV footage.
“Smith was charged on Thursday, 3 November 2011. At Croydon Magistrates’ Court on Wednesday, 16 May 2012, Smith was found not guilty of fare evasion and fined £300 for the racially aggravated offence.
“He must also pay £685 towards court costs, a £15 victim surcharge and £100 compensation each to the victim and another member of rail staff on board the service at the time of the incident.”
