AnsaldoBreda has filed an appeal at the Arnhem Court of Appeal against the judgment of the Utrecht Court in the Summary Proceedings of July the 3rd this year.

Ansaldo Breda, the Italian manufacturer of the Fyra, demands that NS and NMBS make available the three technical reports that they had prepared on the trains and on which NMBS has been relying in June to justify the contract termination; reports that the two companies have been unwilling to provide to AnsaldoBreda.

At the same time AnsaldoBreda has filed an application at the District Court of Utrecht to request a new report by independent experts. The hearing will take place on Thursday 19th of September 2013.
